_Fort Morgan Man Found Guilty on Assault, Burglary Charges
Friday, January 27, 2012

_A Morgan County jury on Tuesday convicted 32 year old Billy David Mackey, from Fort Morgan, on six of the eight charges against him, including felony second-degree burglary of a building, felony theft of $1,000 to $20,000, two counts of felony menacing with a weapon, obstruction of justice and harassment.

The jury found Mackey not guilty on charges of first-degree assault -- threatening a peace officer and a separate count of felony menacing with a weapon. Morgan County District Court Judge Kevin Hoyer accepted the jury's verdict and set sentencing for March 27.

The case stems from a standoff June 27, 2011, at the New Concept Inn in Fort Morgan, where Morgan County Sheriff's deputies responded to a suspected domestic violence call. When confronted, Mackey pulled a knife out of his pocket and "held it in a threatening manner" toward Sheriff's Deputy Eric Nickell.

Another Deputy then used a taser on Makey after he ignored requests to drop the weapon; but the taser had little effect. The deputy then shot his service pistol twice, wounding Mackey.

Mackey was also suspected in an attempted robbery that occurred earlier that day.

Fire at Gateway Apartments Displaces Families
Friday, January 27, 2012

_Several Fort Morgan families will be placed in other living quarters after an early-afternoon fire damaged their units in the Gateway Apartments complex in Fort Morgan.

No one was injured in the fire, and firefighters had the blaze contained within about 30 minutes.

A call from a resident of a third-floor apartment who smelled smoke was received about 12:45 p.m. Thursday, January 26th, according to Fort Morgan Volunteer Fire Department spokesman Trae Boehm. The Fort Morgan department responded within minutes, eventually bringing a total of 23 firefighters and the department’s ladder truck, three engines and a rescue unit.

Other residents of the apartment building had evacuated on their own and the complex’s maintenance person was attempting to put out the fire with an extinguisher when firefighters arrived. Fort Morgan Police checked all of the apartments in the 12-unit Building B on the complex’s east side to be sure none were occupied.

Because the fire was in an apartment building and the extent of it was unknown at first, assistance was requested from neighboring fire departments to ensure sufficient manpower and equipment were available to prevent the fire from spreading.

The Brush department sent six firefighters and an engine, and Wiggins firefighters were en route before they were called off because the incident was under control, Boehm said. Fort Morgan Police, the Morgan County Sheriff’s Office and Morgan County Ambulance Service also responded, along with workers from Fort Morgan’s electric and building departments and other utility departments.

It is believed the fire started in a ceiling exhaust fan in a bathroom of the second-floor apartment below the unit from which the fire call originated. It burned up into the third-floor apartment, and both units were heavily damaged by fire as well as smoke and water. Boehm said the first-floor unit beneath the source of the fire was also likely uninhabitable due to damage from the water used to fight the fire.

The Red Cross was contacted and was preparing to assist with placing the affected families in other living quarters and helping with other needs like clothing and food, said Fort Morgan Police Chief Keith Kuretich. Kuretich said he was told by the maintenance worker that the apartment complex’s insurance would cover the cost of alternate housing for the displaced families.

Boehm said the fire was a serious incident that could have been much more catastrophic. He said fires in multi-story apartment buildings are “some of the hardest fires we fight” because of access problems and other issues.

Four firefighters entered the apartment on the initial attack, and a total of about 10 had cycled through the apartment by the time the fire was out, Boehm said. The FMVFD used its ladder truck to provide a “secondary egress” from a window of the second-floor apartment.

Among the 23 FMVFD volunteers who responded were five retired firefighters, Boehm said. The department began a system several years ago to send text messages even to retired firefighters for calls on which extra help may be needed, he said.

Man Takes Own Life Outside Brush Hospital
Thursday, January 26, 2012

_Late Wednesday afternoon a man took his own life just outside of the East Morgan County Hospital in Brush.  Jasper Carter, age 57, was pronounced dead at Colorado Plains Medical Center about 40 minutes after the 5:05pm shooting.

Deputies were dispatched to the hospital Wednesday afternoon to meet with a local woman who was being treated for injuries sustained in a violent assault at a residence in the 22,000 Blk of Rd 25.  EMCH had gone into lockdown when the woman reported Carter told her he would kill her and himself and was armed with a handgun.  It was also learned Carter was a retired law enforcement officer from the Denver metro area with SWAT experience.

Other deputies began searching around the residence for Carter and at 5:02pm he was discovered sitting in his pickup on Harvard Street alongside the main parking lot of EMCH.  Due to the circumstances, plus with the victim still being inside the hospital building, Carter was confronted immediately with hope of taking him by surprise and preventing a possible vehicle pursuit and/or armed confrontation.

However upon being confronted, Carter refused commands to surrender and stepped out of the pickup with a handgun.  Despite numerous commands to drop the gun and surrender, Carter shot himself under the chin and was immediately incapacitated.

Carter was transported to CPMC by ambulance where he died a short time later.

This incident is being investigated by the sheriff’s office, Brush Police Department, 13th Judicial District Attorney’s Office and Morgan County Coroner's Office, with assistance from the Fort Morgan Police Department.

The victim’s name is not being released due to privacy laws.
